1. Acceptance of Terms

By accessing, browsing, or using the Frost Flame Arcade website located at frostflamearcade.com (“the Platform”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (“Terms”). These Terms constitute a legally binding agreement between you (“User,” “you,” or “your”) and Frost Flame Arcade (“we,” “us,” or “our”). If you do not agree to these Terms, you must immediately cease using the Platform and navigate away from the site. Your continued use of the Platform following any modifications to these Terms constitutes acceptance of those changes.

2. Eligibility

Frost Flame Arcade is intended exclusively for individuals who are at least 19 years of age and reside in Canada. By using this Platform, you represent and warrant that you meet both of these eligibility requirements. We reserve the right to request proof of age at any time and to suspend or terminate access for any user who does not meet the minimum age requirement. If you are accessing the Platform on behalf of another individual or entity, you represent that you have the authority to bind that individual or entity to these Terms.

3. Description of Service

Frost Flame Arcade is a free social entertainment platform that provides users with access to colorful games, interactive modules, and digital experiences, including but not limited to Viking Voyage. All content on the Platform is provided purely for entertainment purposes. No real money is involved at any stage of the experience. The Platform does not offer any form of monetary rewards, prizes, or payouts. All gameplay elements, scores, points, and achievements are entirely virtual and hold no monetary value. We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time without prior notice.

4. User Conduct

When using Frost Flame Arcade, you agree to the following standards of conduct:

• You will not use the Platform for any unlawful purpose or in violation of any applicable Canadian federal, provincial, or local laws and regulations.
• You will not attempt to gain unauthorized access to any portion of the Platform, other users’ accounts, or any systems or networks connected to the Platform.
• You will not use automated scripts, bots, or other tools to access or interact with the Platform without our express written permission.
• You will not transmit any viruses, malware, or other harmful code through the Platform.
• You will not harass, abuse, threaten, or intimidate other users of the Platform.
• You will not upload, post, or transmit any content that is obscene, defamatory, or infringes on the intellectual property rights of others.
• You will not interfere with or disrupt the Platform or the servers and networks used to make the Platform available.

We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates these standards of conduct.

5. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, digital downloads, data compilations, software, game designs, and the overall look and feel of the Platform, is the exclusive property of Frost Flame Arcade or its content suppliers and is protected by Canadian and international copyright, trademark, and other intellectual property laws. The Frost Flame Arcade name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Frost Flame Arcade. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial entertainment purposes only.

6. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE CANADIAN LAW, FROST FLAME ARCADE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS IN THE PLATFORM WILL BE CORRECTED. YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE CANADIAN LAW, IN NO EVENT SHALL FROST FLAME ARCADE, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE PLATFORM. OUR TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THE PLATFORM SHALL NOT EXCEED ONE HUNDRED CANADIAN DOLLARS (CAD $100.00).

8. Indemnification

You agree to defend, indemnify, and hold harmless Frost Flame Arcade and its officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, actions, demands, liabilities, costs, and expenses, including reasonable legal fees, arising out of or related to your use of the Platform, your violation of these Terms, your violation of any rights of a third party, or any content you submit or transmit through the Platform. This indemnification obligation will survive the termination of these Terms and your use of the Platform.

9. Termination

We reserve the right to suspend or terminate your access to the Platform at any time, for any reason, without prior notice or liability. Reasons for termination may include, but are not limited to, breach of these Terms, suspected fraudulent or abusive activity, or requests by law enforcement or government agencies. Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Canada and the province in which Frost Flame Arcade operates, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Platform shall be resolved exclusively in the courts of competent jurisdiction in Canada. You consent to the personal jurisdiction of such courts and waive any objection to the exercise of jurisdiction over you by such courts. If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

11. Changes to Terms

Frost Flame Arcade reserves the right to modify, amend, or update these Terms at any time at our sole discretion. When we make material changes to these Terms, we will update the “Last updated” date at the top of this page. We encourage you to periodically review these Terms to stay informed of any updates. Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes. If you do not agree to the amended Terms, you are expected to discontinue your use of the Platform immediately.
